These Terms and Conditions govern your use of our services and communications, including SMS text messaging.

Services

Smoky Mountain Deck Builders LLC provides residential construction services including decks, docks, screen rooms, pergolas, outdoor kitchens, fire features, fencing, hardscapes, and outdoor lighting in East Tennessee.

SMS / Text Messaging Terms

Smoky Mountain Deck Builders LLC (“SMDB”) sends text messages from its business line, **(865) 420-3325**, to customers, crew members, subcontractors, vendors, and business partners (including our marketing and website partner, Midwest Communications / MWC Advertising). Messages may be sent by SMDB staff or by “Nick’s assistant,” SMDB’s assistant service acting on behalf of owner Nick DiRoberto.

  • Consent and opt-in: By providing your mobile number to SMDB (for example on our website contact form, on an estimate or contract, during crew or subcontractor onboarding, or by texting us first), you agree to receive text messages from SMDB at that number. Consent to receive text messages is not a condition of purchasing any goods or services.
    Message types: Scheduling and appointment coordination, job and project updates, payment and invoice questions, end-of-day work check-ins (hours, work completed, and photos), and replies to questions you send us.
  • Message frequency varies based on your project or working relationship with SMDB.
  • Message and data rates may apply based on your mobile carrier plan.
  • Opt out: Reply STOP at any time to stop receiving text messages. You will receive one confirmation message, and no further texts will be sent unless you opt back in.
  • Help: Reply HELP for help, or call (865) 320-6990.
  • Privacy: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy at smokymountaindecks.com/privacy-policy.
  • Carrier liability: Mobile carriers are not liable for delayed or undelivered messages.

Payments

Payment terms are as specified in individual project contracts. Final payment is due upon project completion per contract terms.

Warranty

We provide a 1-year warranty on workmanship, covering labor and installation. Natural products such as wood are excluded. Manufacturer warranties are separate.

Limitation of Liability

Our liability is limited to the contract value of the specific project. We are not liable for indirect, incidental, or consequential damages.

Governing Law

These terms are governed by the laws of the State of Tennessee.
